Terms of Service
The Catalyst Studio · Version 1 · Effective 10/13/2026
These terms are an agreement between THE CATALYST STUDIO, LLC, an Illinois limited liability company ("we", "us"), and the business that signs up for our website service ("you").
By ticking "I agree" at checkout, you accept these terms on behalf of your business and confirm you're authorized to do so. The service is for businesses only, not for personal or household use.
1. What you get
For $99 a month we:
- design and build a website for your business
- host it, with a secure (HTTPS) connection
- register a standard domain name (a .com or similar) for you if you don't have one (section 5)
- make a reasonable number of small updates when you ask: hours, services, prices, photos and text. We usually finish them within 3 business days
- keep the site's software up to date
Redesigns, new features and anything else not listed above cost extra. We'll quote first and charge nothing extra without your written OK (an email is fine).
2. Price and billing
- $99 a month. No setup fee. No minimum term.
- Stripe charges your card when you sign up, and again at the start of each billing period until you cancel. A billing period is one month, starting on the same date each month as your first charge. We never see or store your full card number.
- The $99 includes any sales tax. You pay nothing on top of it.
- Price changes: we'll email you at least 30 days before a new price applies. It starts at the beginning of your first billing period after that notice. If you don't want to pay it, cancel before then.
3. Cancelling
- Cancel any time, online through the billing link in any receipt, or by emailing us. No fee, and no reason needed.
- 10-day money-back guarantee. If you cancel before your site goes live, or within 10 days after it goes live, we'll refund your first payment in full. We process the refund within 30 days.
- Otherwise, your site stays up until the end of the billing period you've already paid for, then comes down. We don't refund partial billing periods.
- When you cancel, you keep your domain and your content. The site itself, which we designed and built, comes down (section 6).
- We'll confirm your cancellation by email.
4. If a payment fails
We'll email you and Stripe will retry the card. If the payment is still unpaid 10 days after it failed, we take the site down. No charges accrue while the site is down.
If you pay the overdue amount within 90 days of the takedown, we'll put the site back up and billing continues from there. After 90 days, we may delete our copy of the site.
If the site stays down, we'll offer to hand you the domain before it needs renewing; after 90 days we won't renew it.
5. Your domain name
- If you already have a domain, it stays yours. You give us enough access to point it at your site.
- If you don't, we register one for you in your business's name: a standard .com or similar. We pay for it and manage it while you're a client. A premium name costs extra, and we'll quote it first.
- Whenever you ask, and when you leave, we'll hand you full control of the domain. Once you've left, renewing it is up to you.
6. Who owns what
- You own your content: your business information, text, photos and logo, and anything else you give us. You let us use it to build, run and show your site.
- We own the design and code of the site, including our templates. While you're a client, you may use them for your site.
- When you leave, your right to use the design and code ends. On request, we'll send you a copy of your content within 30 days.
- Stock photos we add are used under their own licenses and stay on your site only while you're a client.
- Our portfolio: we may show your site, with a link, as an example of our work. Tell us if you'd rather we didn't, and we'll stop.
7. Your responsibilities
- Give us accurate information about your business and tell us when it changes.
- Only give us content you have the right to use. For photos of people, that includes their permission.
- Don't ask us to publish anything illegal, misleading or infringing.
We may refuse or remove content that breaks this section. Where we can, we'll tell you first.
If you connect your Facebook Page or another account, we use it only to keep your site accurate. You can disconnect it at any time. Our Privacy Policy explains what we collect and how we handle it.
Your site's visitors. Your site carries our standard privacy notice, published as your business's own on your site's /privacy page. We fill it in with your business details and keep it matched to the features your site has (a contact form, a booking link, visit counts). We handle what visitors send through your site, such as contact or appointment requests, only to run the site and pass it on to you. By agreeing to these terms you adopt that notice as your own and agree to keep its promises: you use what visitors send through the site only to answer them and see them for appointments, you don't sell it or share it for targeted advertising, and you delete it when someone asks. Tell us before you use visitors' information any other way (sending offers, say), so we can update the notice first. You can read the current template at insidecatalyst.com/client-notice.
8. What we don't promise
We work to keep your site running and secure, but outages happen, including at the hosting companies we rely on. We provide the service "as is" and, as far as the law allows, make no other promises, express or implied, including that the site will be uninterrupted or error-free, or bring in any particular amount of business. We build sites to be accessible, but we don't promise that a site meets any particular accessibility standard.
9. Limits on liability
As far as the law allows:
- Neither of us is liable to the other for lost profits, lost data, or any indirect or consequential loss.
- Our total liability for any claim is limited to what you paid us in the 12 months before the claim arose.
The cap doesn't apply to what either of us owes under section 10, or to a refund we owe under section 11.
This section doesn't limit liability that the law doesn't allow to be limited.
10. Claims about content and design
- If someone makes a claim against us because of content you gave us (for example, a photo you didn't have the right to use), you'll cover our reasonable costs of dealing with it.
- If someone claims our design, code or the stock photos we chose infringe their rights, we'll cover your reasonable costs.
11. If we end the service
We may end the service:
- for any reason, with 30 days' notice. If you've paid past the end date, we refund the unused part.
- immediately, if you seriously break these terms, such as by asking us to publish illegal content.
However the service ends, sections 5 (your domain), 6 (who owns what), 9 (limits on liability), 10 (claims about content and design) and 13 (disputes) still apply.
12. Changes to these terms
- Every version of these terms has its own permanent web address, and the current one is always at insidecatalyst.com/terms.
- We'll email you at least 30 days before a new version takes effect, and say what changed.
- If you keep the service after that date, the new version applies. If you don't agree to it, cancel before then; you won't be charged under the new terms.
- A new version never applies to a dispute that arose before it took effect.
- If a change takes away a right you have under these terms, such as adding arbitration or lowering our liability limit, it applies to you only once you've accepted it by ticking a box or replying to say so.
13. Disputes
Contact us first, and we'll try to sort it out.
Illinois law governs these terms. Any lawsuit goes to the state courts in Kankakee County, Illinois, or the U.S. District Court for the Central District of Illinois, but either of us may use small claims court.
14. The rest
- These terms are the whole agreement between us about the service. Our Privacy Policy explains how we handle information; it isn't part of this agreement.
- If a court finds part of them unenforceable, the rest still applies.
- If we don't enforce a term right away, we can still enforce it later.
- Neither of us is responsible for delays caused by events outside our reasonable control.
- Neither of us may transfer this agreement without the other's consent, except to someone who takes over the business.
- We send notices to the email address on your account. You send notices to us at [email protected].
15. Copyright complaints
If you believe something on a site we host infringes your copyright, send a notice to our designated agent: Copyright Agent · THE CATALYST STUDIO, LLC · mailing address 963 N Convent St, Ste D #1050, Bourbonnais, IL 60914 · (815) 627-0618 · [email protected]. We remove or disable material when the law requires it, tell the client whose site it's on, and follow the counter-notice process in 17 U.S.C. §512(g). We end the service for a client who repeatedly posts infringing material.
